Follow-up: DEM Requirements & Legal Opinion
At the end of last month, we informed you that the Direction de l’enseignement à la maison (DEM) was rolling out its pilot project—the optimized monitoring—to all families. Here’s a brief update on the latest developments.
Legal Opinion
AQED consulted legal counsel to assess whether the optimized monitoring complies with the Regulation respecting homeschooling.
The conclusion is clear: the optimized monitoring, as imposed by the DEM, does not comply with the Regulation currently in force.
According to the legal opinion, this new approach does not align with the obligations set out for parents, namely the submission of a written progress report and a written status report.
It is also specified that neither the DEM nor the Minister has the authority to impose these changes under the current Regulation.
As a result, we recommend that families continue submitting their documents as usual in order to meet the legal obligations set out in the Regulation.
If your family has already had its annual meeting, you may still submit your documents through the secure portal.
Meeting with the DEM
A meeting with the DEM was scheduled for Wednesday, December 17, but was unfortunately cancelled by their team. A new meeting is, however, planned for sometime in January. We will be sure to keep you informed of any developments.
